Sowore Withdraws Plan To Call DSS DG As Witness

Online publisher and African Action Congress (AAC) presidential candidate, Omoyele Sowore, has withdrawn his plan to call the Director-General of the Department of State Services (DSS), Oluwatosin Adeola Ajayi, as a defence witness in his ongoing trial over alleged criminal defamation of President Bola Tinubu.


At the resumed proceedings before the Federal High Court in Abuja, Sowore informed the court that the evidence he had earlier sought from the DSS Director-General through a subpoena could instead be provided by another official of the agency.


For the first time since the commencement of the trial, the Attorney-General of the Federation (AGF) and Minister of Justice, Prince Lateef Fagbemi, SAN, personally led the prosecution on behalf of the Federal Government.


Fagbemi opposed the subpoena issued to the DSS Director-General, arguing that the document the witness was expected to produce was not authored by Ajayi but by another DSS official, who had already testified in the case.


According to the AGF, the DSS letter advising Sowore to delete social media posts in which he described President Tinubu as a "criminal" had already been tendered and admitted in evidence on two separate occasions before the same court, making any further attempt to tender it unnecessary.


He further submitted that the author of the letter, Mr Uwen Davis, testified as a defence witness on July 22, and that the document was already in the court's custody.


Counsel to Sowore, Adeyinka Olumide Fusika, objected to the AGF's appearance in the matter, contending that the court's records recognised Akinlolu Kehinde, SAN, as counsel representing the Federal Government.


After hearing the parties, the presiding judge, Justice Muhammed Umar, adjourned the case until Monday, August 3, for the continuation of Sowore's defence.
